Terms and Conditions
Last updated:
These are the general terms for our services, translated from the Spanish original. Some services also have their own terms, which are only available in Spanish.
1. General
By hiring the services of Garibay Marketing, the client accepts these Terms and Conditions. Any later change to the scope of the original service must be quoted and approved by both parties.
2. Payments and delivery
- Every project requires a 50% advance payment to start, unless otherwise agreed in writing.
- The balance must be paid before the final delivery of the project or editable files.
- Late payments may incur an additional administration fee equal to 10% per month of the outstanding amount.
- Delivery of source (editable) files is not included, unless stated in the quote or contract.
3. Changes and revisions
- The number of changes included in the project will be agreed during the quoting stage or in communication before the service starts.
- Any additional change beyond what was agreed may have an extra cost, which will be communicated before the work is done.
4. Cancellations
- If the client decides to cancel the project once it has started, the advance payment is non-refundable.
- If the work is well advanced, a payment proportional to the progress made may be required.
5. Liability
Garibay Marketing is not responsible for:
- Misuse by the client of the content delivered.
- Damages arising from the interpretation or modification of the design by third parties.
6. Use of materials and rights
- All material designed by Garibay Marketing may be used for promotional purposes unless the client states otherwise in writing.
- Intellectual property over the designs, website, automation or any service hired is transferred to the client only once the full service has been paid and if this has been specified in the contract.
- Any project that has not been duly paid and is replicated in part or in full by the client or third parties will be considered an unauthorized clone. Such action is a violation of intellectual property rights and may be prosecuted.
7. Jurisdiction
These terms are governed by the laws of Mexico City. Any dispute will be resolved before the competent authorities of that jurisdiction.
